Who can receive an exceptional pension benefit increase?
Exceptional pension benefit increases may be allowed
- a person in receipt of a pension benefit who is over the retirement age,
- a widow(er) pensioner who is a person with changed working capacity;
- a widow(er) pensioner who supports on a disabled or permanently ill person or on at least two children entitled to an orphan's allowance; and
- a person in receipt of an orphan's allowance.
An exceptional increase in pension benefits may be granted if the combined monthly amount of the pension benefit and other regular cash benefits paid to the applicant does not exceed HUF 120,000.
Who cannot receive an exceptional pension benefit increase?
An exceptional increase in pension benefits cannot be granted to a person who is not in receipt of a pension benefit (e.g.: persons in receipt of a benefit for persons with changed working capacity, disability benefit, old-age pension).
Nor to that person,
- for whom 3 years have not yet elapsed from the date on which the pension benefit was granted and from the date of the previous exceptional increase in the pension benefit, and
- who is in a permanent residential institution,
- who is in residential care or in a youth custody centre,
- who is under pretrial detention, serving an imprisonment sentence.
Where and how to apply for an exceptional pension benefit increase?
The application can be made using the form "Kérelem-adatlap nyugellátás méltányossági alapon történő emeléséhez".
On the application it must indicated by any special circumstances and be accompanied by documents which may justify the application (e.g. certificate of health, health of a close relative, cost of medication, non-payment of public utility bills).
The form, duly completed and signed, must be submitted to the Hungarian State Treasury Centre in the case of persons receiving a survivor’s pension benefit (including orphans), or to the pension insurance administration body of the applicant's place of residence or to the Hungarian State Treasury Centre.
The form can be obtained from the customer services of the pension insurance bodies or downloaded from the website of the Hungarian State Treasury or from the magyarorszag.hu website.
What amount of exceptional pension increase is authorised?
The amount of the increase cannot be less than HUF 3,000 and cannot exceed HUF 8,000.
The authorised exceptional pension increase is "built into" the amount of the pension benefit and is taken into account in the regular annual increase of pension benefits.
Is there a legal remedy against a decision taken within equity competence?
The statement of claim may be lodged against the decision within 30 days of the date of notification to the court with administrative jurisdiction in the place of residence.
