In the case of the death of a beneficiary, who is entitled to receive the benefits to which the deceased was entitled but which has not been taken up by them?
The benefit is payable up to the last day of the month in which the beneficiary died.
The benefit unclaimed in the case of the death of the beneficiary is payable to the spouse, child, grandchild, parent, grandparent and brother or sister living in the same household as the deceased in that order. If there is no relative living in the same household as the deceased, the heirs may take up the benefit in equal proportion upon request within one year of the date of death or the date on which the official legal decision of inheritance becomes final.
To apply, the family member who was living with the deceased must complete the form provided for this purpose, which establishes the relationship, the cohabitation, the deceased's details and the pension registration number of the benefit.
Benefits not taken up may be paid to the heir on the basis of a final official legal decision of inheritance.
If the deceased's partner is considered as heir, the partner can request payment as heir simultaneously with the sending of the same document.
The application can be submitted electronically using the form “Claim in pension insurance case”, or by post, by letter or in person at a customer service.
